This Privacy Policy applies to the MA Chatterbox Service only. To view Market America’s general privacy policy, please visit www.marketamerica.com or your Customer Manager’s Web Portal. The Chatterbox Service is an online social networking service with an integrated shopping solution and is accessible at www.machatterbox.com, www.chatterbox.marketamerica.com and directly associated domains (the “Site”).
Capitalized terms not defined in this Privacy Policy are defined in the Chatterbox Terms of Participation.
We appreciate the trust you place in Market America and we are committed to respecting your privacy and the security of your personal information. This privacy policy describes the information we collect through the Chatterbox Services (“Chatterbox”) and how we use that information.
By using or accessing Chatterbox, you accept the practices described in this Privacy Policy.
1. Information We Collect
To best serve your needs, we will, from time to time, collect certain information from you.
Personal Information. The personal information we collect may include, without limitation, your name, address, telephone number, e-mail address, gender, corporate information, testimonial, credit and debit card information and date of birth. Personal information will be collected at various times including, without limitation, when you:
• Register as a Preferred Customer of Market America
• Register to become a Chatterbox Resident
• Order or reorder products, services and/or gift cards through Chatterbox
• Write an e-mail or letter to Market America
• Submit a testimonial to Market America
• Return an item or make an exchange
• Participate in a marketing survey, promotion or event
• Contact our customer service department
• Visit the Chatterbox Web site
• Enter the Chatterbox Web site
• Navigate the Chatterbox Web site
• Order products and services from our partner stores
Web site Use Information / Cookies. As you interact with our Web site Market America collects certain Web site use information. When you enter Chatterbox we collect your IP address and browser type. This information is collected for all visitors. In addition, we store certain information from your browser using cookies. A cookie is a small data file that is stored by your web browser on your computer. The cookies we use include, without limitation, session ID cookies and persistent cookies. This data may be used for security purposes, to track usage and to manage and improve Market America’s Web site. Cookies also allow us to enhance, personalize and track your online experience, so that the information you receive is more relevant to you. This technology will allow you to move faster through our Web site once the information is in our database since you do not have to re-enter the same information each time you enter the site. Session ID cookies confirm that a Resident is logged in. These cookies terminate once the Resident closes the browser. Persistent cookies store your login ID (but not your password) to make it easier for you to login when you come back to Chatterbox.
Discretionary Information. Visitors to our Web site may elect to register to become Chatterbox Residents. In addition to the Personal and Web site Use Information collected by MA as indicated above, Chatterbox Residents may elect to store information in their profiles, form relationships, send messages, post or otherwise share information, perform searches and queries, form groups, set up events, add applications and/or transmit information through various channels (“Social Networking Activities”). Information provided during Social Networking Activities may include, without limitation, date of birth, interests, hobbies, lifestyle choices, groups with whom they are affiliated (ex. schools, companies), videos, pictures, private messages, bulletins, blogs and personal statements (“Resident Content”). Chatterbox Residents participate in the Social Networking Activities and provide Resident Content in their sole discretion. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent or easily see your neighbor list. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.
Risk of posting Resident Content. You post Resident Content on the Site at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other visitors or Residents with whom you may choose to share your pages and information. Therefore, we do not guarantee that Resident Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of your Resident Content may remain viewable in cached and archived pages or if other Visitors or Residents have copied or stored your Resident Content.
2. Using Information We Collect
We want to provide you with the best possible Internet experience, provide you with a high-end and user friendly social network and fulfill your orders exactly as you've requested. Additionally, we want to make your experience as a Chatterbox Resident a pleasant one.
In order to do this, we collect information that allows us to, without limitation:
Shopping
• Process your order
• Match you up with the Customer Manager that is the best possible fit for you
• Provide the products and services you request
• Partner with stores where you like to shop
• Send you promotional offers for products/services
• Identify your product and service preferences
• Customize our communications to you
• Provide information concerning products you have purchased
• Improve our product selection and customer service
• Share your positive product testimonials with others
• Include your name, stories, testimonials and images in Market America publications and literature or other media, on Market America operated Web sites, at Market America events, on Market America CDs and DVDs, in any other Market America communications to our Independent Distributors or others, or as otherwise deemed useful or appropriate by Market America.
Social Networking
When you register with Chatterbox, you create your own privacy settings. Your Resident Content is displayed to people in the networks specified in your privacy settings to enable you to connect with people on Chatterbox. We may occasionally use your name and e-mail address (as provided in your Resident Content) to send you notifications regarding new services offered by Chatterbox that we think you may find valuable.
Resident Content is primarily used by Chatterbox to be presented back to and edited by you when you access the Site and to be presented to others permitted to view that information by your privacy settings. In some cases where your privacy settings permit it (e.g., posting to your blog), other Chatterbox users may be able to supplement your profile.
Resident Content you submit to Chatterbox will be available to Visitors or Residents of Chatterbox who belong to at least one of the networks you allow to access your information through your privacy settings (e.g., school, geography, friends of neighbors). Your name, network names, and profile picture thumbnail will be available in search results across the Chatterbox network and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. People who see your name in searches, however, will not be able to access your Resident Content unless they have a relationship to you (neighbor, friend of neighbor, member of your networks, etc.) that allows such access based on your privacy settings.
Chatterbox may send you service-related announcements from time to time through the general operation of the Site. For instance, if a friend sends you a new message, or someone posts on your blog, you may receive an e-mail alerting you to that fact.
We may use information about you that we collect from other sources, including but not limited to newspapers and Internet sources such as blogs, messaging services and other Chatterbox Residents, to supplement your profile. Where such information is used, we generally allow you to specify in your privacy settings that you do not want this to be done or to take other actions that limit the connection of this information to your profile (e.g., removing photo tag links).
3. Information We Share with Others
It is not a practice of Market America to sell, rent, or trade personal information.
Shopping
In order to provide you with the best possible service, we will share your order information and limited personal information with the Market America Independent Distributor assigned as your Customer Manager. Market America's Independent Distributors are obligated to treat the information you supply with confidentiality.
We share certain limited information with the partner stores where you shop. Additionally, we contract with other companies to provide certain services, including without limitation credit card processing, IT consulting, printing, shipping, Internet services, e-commerce, public and media relations. We make every effort to provide these companies with only the information they need to perform their services. Generally, such companies are prohibited from sharing this information with anyone other than Market America or its Independent Distributors.
Social Networking
The Chatterbox social network is about sharing information with friends and other people in your networks while providing you with privacy settings that restrict other users from accessing your information. We allow you to choose the information you provide to friends and networks through Chatterbox. Our network architecture and your privacy settings allow you to make informed choices about who has access to your information. We do not provide contact information to third party marketers without your permission. We share your information with third parties in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the service, 2) legally required or, 3) permitted by you.
We let you choose to share information with marketers or electronic commerce providers through sponsored groups or other offers contained on the Site.
Market America may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people in a network like a band or movie and personalizing advertisements and promotions. For example, if you put a favorite movie in your profile, we might serve you an advertisement highlighting a screening of a similar one in your town. But we don't tell the movie company who you are.
When you use Chatterbox, certain information you post or share with third parties (e.g., a friend or someone in your network), such as personal information, comments, messages, photos, videos or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos or other items, this information may become publicly available.
Legal Considerations
On rare occasions, we may disclose specific information upon governmental request, in response to a subpoena or court order, or when required by law to do so. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to report and/or prevent fraud or other illegal activity perpetrated through Chatterbox, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies. We may also share information with companies assisting in fraud protection or investigation. We do not provide information to these agencies or companies for marketing or commercial purposes.
4. Third Party Advertising
Advertisements that appear on Chatterbox are sometimes delivered directly to users by third party advertisers. The third party advertiser will automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. Chatterbox does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on Chatterbox unless you choose to share it with them. This privacy policy covers the use of cookies by Market America on Chatterbox and does not cover the use of cookies or other tracking technologies by any of its advertisers.
5. How We Use E-mail
When you provide us your e-mail address, you may receive e-mails from us or from your Customer Manager. E-mails may be sent in order to help us process your order, respond to a request, provide customer service or inform you about products, services or promotional materials. Additionally, we may occasionally send you notifications regarding new Chatterbox services or features that we think you may find valuable.
It is our intent to send promotional e-mails only to those persons who wish to receive them. We provide instructions on how to unsubscribe in our e-mails. Chatterbox reserves the right to send you notices about your account and your order even if you opt out of all voluntary e-mail notifications.
6. Links to Other Sites
We provide links on our Web site to other sites. These sites operate independently of Market America and have established their own privacy and security policies. We encourage you to review these policies at any site you visit.
7. Updating or Reviewing Your Information
Chatterbox Residents can change their personal Registration information and/or Resident Content at any time and can control how visitors, other Residents and Market America communicate with them by controlling their account settings, available within the “Manage Account” portion of their Chatterbox profile.
You may review or update your Market America Preferred Customer information (name, address, telephone number, e-mail address, credit card number, etc.) under Your Account at www.marketamerica.com.
8. Security
Market America is committed to protecting the privacy of your personal information. It is our intent to protect against the loss, misuse or alteration of information that we have collected from you. We use a variety of current technologies and processes for protection of information we collect, and we limit the information we provide to third parties.
When you make a purchase or submit a document on our Web site, your transactional information is transmitted in a safe, encrypted format.
9. Privacy of Children on Our Web site
Children under age 14. The Chatterbox social network is not intended for use by anyone under the age of 14. Market America does not knowingly collect or solicit personal information from anyone under the age of 14 or knowingly allow such persons to register as Chatterbox Residents. If you are under 14, please do not attempt to register for Chatterbox or send any information about yourself to us, including your name, address, telephone number, or e-mail address. No one under age 14 may provide any personal information to Market America or on Chatterbox. In the event that we learn that we have collected personal information from a child under age 14, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 14, please contact us at webmaster@machatterbox.com.
Children between ages 14 and 18
The shopping feature of Chatterbox is not intended for use by anyone under the age of 18. Market America does not knowingly sell products or services to anyone under the age of 18.
Minors who are 14 or older should ask their parents for permission before sending any information about themselves to anyone over the Internet.
10. Policy Changes
From time to time, we may use your information for unanticipated uses not previously disclosed in our privacy notice. If our information practices change, we will post these changes in our Web site. We encourage you to review our privacy policy periodically.
11. Your Consent
By using Market America facilities including Chatterbox or by continuing to order products and/or services, you consent to the collection and use of your personal information as detailed in this privacy policy.
12. Terms of Participation, Market America General Privacy Policy and Terms of Use, Notices and Revisions
Your use of Chatterbox, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Participation and all of its dispute resolution provisions including limitation on damages and choice of law. We reserve the right to change our Privacy Policy and our Terms of Participation at any time. All changes and clarifications will take effect immediately, upon their posting on this Site. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date. We encourage you to refer to this policy on an ongoing basis so that you understand our current privacy policy. This privacy policy applies to the Chatterbox Services only. Any information you provide to Market America outside of the scope of the Chatterbox Services, including without limitation, through www.marketamerica.com or any other Market America owned or operated Web site, at an event, by telephone or mail is not covered by this privacy policy. To review Market America’s general privacy policy, please visit www.marketamerica.com or your Customer Manager’s Web Portal. In the event that there is a discrepancy between this Privacy Policy and Market America’s general privacy policy, this privacy policy shall govern.
